Call for management of SAS to explain RM400 mln loss

KOTA KINABALU - Sabah Amanah Saham (SAS) unit holder Chin Chow Cheow of Tawau yesterday led a group of unit holders urged Deputy Chief Minister Datuk Dr Yee Moh Chai to get the Sabah Amanah Saham management to hold a general meeting and explain to all SAS unit holders the truth and the reasons for the loss of RM400 million.

Chin said the SAS management had a duty and obligation to explain truthfully to all SAS unit holders the real reasons as to how the RM400 million loss was incurred and to make public all transaction records so that the masterminds behind this huge loss could be uncovered and charged in court.

He said the state government must fully investigate the case, publish a White Paper and apprehend the real culprits irrespective of whether they are senior government officers, politicians or their cronies.

"Dr Yee, having been a minister for 10 years, knows the truth of the SAS fiasco," he said.

He added that it is cruel and hypocritical for Dr. Yee’s uncle Yong Pek Fong to accuse an innocent person like Datuk Yong Teck Lee whilst Yee turns a deaf ear to the repeated demands of all SAS unit holders to investigate and publish the truth.

    The State Assembly rejected a motion to present a White Paper on the Saham Amanah Sabah (SAS) after Barisan Nasional members unanimously rejected it. BN Assembly members viewed the motion tabled by Likas Assemblyman Datuk Liew Teck Chan of Sabah Progressive Party as serving only the interest of party president Datuk Yong Teck Lee.

    He argued that a White Paper by definition was a document produced by the government that allowed an examination to be made and feedback to be gathered to enable certain proposals or programmes to be improved and implemented effectively.

    If there is going to be a White Paper, it should not be about looking into the past. It must be about looking into the future of Saham Amanah Sabah. We are here to put the interest of the people first, not the interest of a former Chief Minister. As such I request that the motion be rejected, he said.

    Raymond added that an elected representative did not have the right to ask for a White Paper to be tabled at the State Assembly as the regulation stated that only the Speaker of the House and a government Minister could make such a request, if they felt it was necessary.

    He also said the White Paper, even if it were to be produced, would not serve as a political salvation for the SAPP president who had been under pressure after BN leaders demanded that he should explain the ridiculous and unacceptable huge losses.

    The SAS issue resurfaced as a hot topic recently after Human Resource and Information Technology Minister Datuk Dr Yee Moh Chai asked Yong to come clean on the issue. The two leaders had exchanged barbs through media over the issue.

    Dr Yee also questioned why Yong, through SAPP, only insisted on having a White Paper now when he, as the then Chief Minister, could have ordered for such document to be produced if he was sincere about looking into the SAS issue.

    The share value of SAS, he added, continued to tumble to its lowest point in 1997 during the second year of Yong's reign but there was no apology from the latter to the SAS investors until today.

    Instead, all we got from Datuk Yong was his very arrogant statements relating to the performance of SAS during his tenure as Chief Minister, he said. Dr Yee also refuted Yong’s statement published on Monday that defended the shares deal with Warisan Harta and Suniwang Holding in 1997/98.

    Yong had said that the government, through Warisan Harta, could utilise the RM50 million fund to support counters in which the company and the people of Sabah has invested in. Yong also said the move would bring positive results for SAS.

    The result of this deal was a disastrous loss of RM114 million, Dr Yee said, adding that Saham Amanah Berhad which managed the SAS had confirmed with him that they have never received anything from the RM50 million in question.

  29. Ini didedahkan oleh Pengarah Briskmark Enterprise Sdn Bhd, Datuk Wasli Mohd Said, yang ketika itu merupakan Pengurus Besar Lembaga Kemajuan Tanah Negeri Sabah (SLDB). Beliau berjumpa Yong TL di pejabatnya untuk memberikan taklimat mengenai cadangan pengambilalihan pengurusan 40 peratus saham Sapi Plantation bernilai RM16.8 juta.

  30. Pendedahan dibuat Wasli ketika dihadapkan di Mahkamah Sesyen Kota Kinabalu 12 Februari 2004 untuk menghadapi 5 pertuduhan rasuah melibatkan RM1 juta dan pemberian saham 3.36 juta unit saham milik SLDB.

  32. Menjelang PRU 1999, Yong menerima sejumlah wang lagi daripada Wasli. Wasli turut diarahkan memberi hadiah berupa wang tunai RM500,000 kepada lapan ahli lembaga pengarah Bismark, selain Yong, beliau membayar wang tunai RM500,000 kepada setiap daripada lapan anggota lembaga Briskmark sebagai derma kepada mereka. Mereka ialah Datuk Salleh Otik, Datuk Ismail Jook, Abdul Kader Pateh, Laimun Laikim, Michael Emban, Talib Aning, John Liaw dan Catherine Yong(Adik kepada Yong Teck Lee).

Ketika menjadi ketua Menteri Sabah, beliau ada kaitan dengan sebuah syarikat iaitu Warisan Harta Sabah (WHS) rugi RM114 juta, berikutan keputusan Yong (ketika itu Pengerusi WHS) mengarahkan ‘share swap’ pemilikan saham WHS dalam MISC sebuah syarikat yang dianggap memiliki saham ‘blue chips’ dengan saham North Borneo Trading (NBT) dan Sugarbun Corporation Berhad, dimiliki dua usahawan dari Sarawak yang merupakan saham spekulatif.

  36. Lebih 55 ribu pelabur Sabah, yang kebanyakannya terdiri daripada pesara dan yang berpendapatan rendah kehilangan pelaburan mereka (pada 1996) akibat kejatuhan saham SAS daripada RM1 seunit kepada 17 sen seunit ketika itu.

  37. Selama tempoh dua tahun Yong menjadi KM Sabah, banyak dasar-dasarnya tidak popular termasuk memperkenalkan Forest Management Unit (FMU) yang mengasingkan 2 juta hektar kawasan balak negeri Sabah kepada kurang daripada 20 syarikat untuk tempuh 100 tahun.

Semasa menjadi Ketua Menteri terlalu banyak hak-hak rakyat dikatakan telah dinafikan oleh beliau dan antaranya adalah :geran-geran tanah untuk kampung-kampung tradisional Melayu seperti kawasan Inanam, Gudon,Tebobon,Karambunai dan Menggatal tidak diluluskan bagi tujuan pemilikan kerajaan negeri (untuk keuntungan peribadi).Tiada kontrak untuk kontraktor bumiputra.Tiada peluang pekerjaan untuk anak-anak Bumiputra.

Hak rakyat lain yang dikatakan diambil oleh Yong ialah 1 juta ekar konsesi balak untuk tempoh 100 tahun bernilai lebih RM20 Billion dari Tenom hingga ke Kalabakan,Tanah persisiran laut di Teluk Likas bernilai lebih RM500 juta,Tanah persisiran laut di Tanjung Aru bernilai lebih RM500 juta.,Tanah-tanah Lembaga Kemajuan Tanah Sabah (SLDB) bernilai lebih RM2 billion diambil melalui Sawit Kinabalu Sdn Bhd.

Wang saham rakyat dalam Koperasi Pembangunan Desa (KPD) bernilai RM60 juta diambil melalui Benta Holdings,Duit rakyat diperbendaharaan negeri berjumlah RM36 juta setahun melalui Angkatan Hebat Sdn Bhd (kontrak sewa kereta kepada semua agensi kerajaan, Merobohkan rumah-rumah kerajaan di Tanjung Aru untuk pembinaan resort oleh sebuah syarikat kroni tetapi sehingga kini tanah tersebut terbiar kerana tanah berkenaan tidak mempunyai geran.

Yong juga dipercayai mempunyai perwatakan pemimpin yang tidak boleh dipercayai malah disifatkan antara pemimpin yang mendokong sifat opurtinis dengan mengambil kesempatan atas hubungan baiknya dengan Datuk Joseph Pairin Kitingan hingga membolehkan beliau diberi kepercayaan memegang jawatan Timbalan Presiden PBS pada 30 September 1989. Pada 19 Julai 1990, Yong dilantik oleh Ketua Menteri (Pairin), sebagai Timbalan Ketua Menteri merangkap Menteri Pembangunan Industri sehingga 19 Januari 1994.

Rentetan krisis dalaman PBS pada waktu itu mendorong Yongo keluar PBS bertindak pantas menubuhkan sebuah parti baru iaitu SAPP pada 19 Januari 1994 dengan membuka keahlian kepada semua kaum, sama seperti PBS. Yng menjadikan 'hilang kepercayaan' sebagai alasan meninggalkan Presiden Parti Bersatu Sabah (PBS), Datuk Seri Joseph Kitingan, yang bertanggungjawab membawanya masuk dalam politik Bahkan, Yong sendiri mengepalai kumpulan mengkhianati Pairin.

Pada 18 Jun 2008, Teck Lee yang menjadi Presiden SAPP mengatakan mereka hilang kepercayaan terhadap kepimpinan Datuk Seri Abdullah Ahmad Badawi dan bersedia untuk menyokong sebarang undi tidak percaya terhadap Perdana Menteri. Kemudian Yong umum SAPP keluar BN pada 17 September 2008 walaupun gerakan 16 September Anwar gagal.

  77. Sebelum p.raya dia minta jawatan Senator sahaja, selepas keluar keputusan dia minta untuk jadi menteri pula. Pak Lah tidak bersetuju dengan perkara tersebut kerana beliau harus beri peluang kepada MP-MP yang lain dari Sabah untuk menjadi menteri.

  81. Prinsip yang dipakai oleh Anwar dan YTL adalah 'siapa cepat dia dapat'.Maksudnya, siapa cepat menyeberang ke PKR atau SAPP sehingga cukup kerusi untuk menubuhkan kerajaan maka MP tersebut akan mendapat habuan dalam kerajaan baru. Sesiapa yang lambat akan ketinggalan dan jadi pengikut sahaja.

  95. No one has disputed this. But what has not been answered is that the money received by Warisan was never given to SSB as Yong has said. Yong was the Chief Minister and Warisan Chairman. Yet he has failed to tell Sabahans what happened to the RM50 million which he, as Warisan Chairman, received and which he never gave to SSB.

    Dr Yee Moh Chai, Minister of Resource Development and Information Technology, told the assembly on August 3 that Saham Sabah Berhad (SSB) which manages the SAS has confirmed to him that it has never received the RM50 million out of the share dealings of Warisan Harta.

The true outcome, according to Dr Yee, is that as a result of the share-swap deals, Warisan Harta lost RM114 million.

    Ambrose blamed Warisan for the loss because it refused to accept his offer to pay RM96 million for the difference between its purchase and market price of NBT and Sugar Bun shares which he said fell sharply because of the Asian financial crisis.

Thus Warisan sued Suniwang for RM179,825,000. True enough, Suniwang folded. Warisan did not get a sen. If Ambrose had the money, would his flagship Suniwang Holdings Sdn Bhd collapse like a pack of cards?

    Ambrose blamed Musa Aman, who was then Finance Minister, for rejecting again his proposal in 2007 to settle his debt of RM179,825,000 by transferring shares of Borneo Marble Corporation Sdn Bhd which he owned through proxies.

  104. He said Warisan had entertained his proposal but the Sabah government rejected it. Warisan officials said it was true that they entertained his proposal but it did not accept it because the company was a liability.

    Recently filings with the Companies Commission of Malaysia have proved this to be so. Borneo Marble was formerly known as Galmore Resources Sdn Bhd and was a fully-owned subsidiary of Suniwang Sdn Bhd which was owned by J Ambrose Sdn Bhd.

  106. By his own admission, he has a Receiving Order of the court placed on his assets under the control of an official assignee. He has not been adjudicated a bankrupt yet.

    Any chance of the Sabah government bailing him out now hinges on the remote chance of Yong Teck Lee becoming Sabah’s Chief Minister again. And why shouldn’t he? After all it was Yong’s late father, Yong Yun, who financed Ambrose’s law studies in London.

  121. Kerana Memfitnah, Yong Teck Lee Diarah Bayar RM1 Juta

    Mahkamah Tinggi Kota Kinabalu pagi tadi memerintahkan Presiden Parti Maju Sabah, SAPP, Datuk Yong Teck Lee membayar RM1 juta kepada bekas Ketua Menteri, Tan Sri Harris Salleh.

    Ia atas dakwaan memfitnah Tan Sri Harris berhubung nahas pesawat 6 Jun 1976 yang mengorbankan Ketua Menteri Sabah ketika itu, Tun Mohd Fuad Stephens bersama 10 yang lain.

    Dalam penghakimannya, Hakim Datuk Abdul Rahman Sebli berkata, Datuk Yong bertindak di luar batasan dengan menyatakan bahawa terdapat darah di tangan Tan Sri Harris walaupun tidak salah untuk beliau meminta agar siasatan semula dilakukan berhubung tragedi itu.

    Mahkamah juga mendapati, perkataan jenayah dan pembunuhan yang digunakan Datuk Yong adalah satu fitnah terhadap Tan Sri Harris.

    Hakim juga berpendapat, RM1 juta yang dikenakan adalah jumlah yang adil dan wajar setelah mengambil kira semua aspek termasuk perilaku dan hujah defendan yang masih lagi memburukkan keperibadian dan kewibawaan Tan Sri Harris.

    Tan Sri Harris memfailkan saman RM50 juta terhadap Datuk Yong sebagai defendan pertama dan SAPP sebagai defendan kedua kerana mendakwa kononnya beliau ada kaitan dengan punca pesawat itu terhempas.

    Presiden SAPP Datuk Yong Teck Lee mengakui bahawa adalah tidak mudah untuk mengalahkan BN. Namun, mantan Ketua Menteri Sabah itu menaruh keyakinan akan memberikan tantangan kepada BN bersama-sama dengan parti pembangkang yang lain.

    Sebenarnya kenyataan Teck Lee itu mempunyai kebenaran, perjuangan pembangkang sebenarnya tidak mempunyai visi yang jelas, kerana apa yang mereka sering perkatakan sebenarnya telah, sedang dan akan dilaksanakan oleh kerajaan BN.

    Pemimpin pembangkang adalah terdiri daripada mereka yang telah kecewa kerana semasa dalam kerajaan dahulu, ketamakan mereka tidak berpanjangan.

    Mereka kini, sekali lagi mahu mencuba memperguna semula rakyat untuk mendapatkan kuasa, agar supaya visi peribadi mereka tercapai.

    Pemimpin Parti pembangkang di Sabah kebanyakannya adalah para pemimpin kerajaan suatu ketika dahulu, atau mereka-mereka yang pernah menikmati sumbangan daripada kerajaan.

    Disebab tujuan peribadi mereka tidak tercapai, maka mereka beralih mendapatkan kerajaan melalui sistem demokrasi dengan mempergunakan rakyat.

    Yakinlah melalui sistem maklmut yang semakin canggih yang menyebabkan perkongsian maklumat dengan begitu cepat, maka usaha pembangkang mengalih kerajaan melalui sistem demokrasi tidak akan kesampaian, kerana rakyat telah bijak menilai mana kaca dan mana intan.

    Rakyat tahu, bahawa pembangkang bertujuan mendapatkan kuasa kerana kepentingan peribadi bukannya kepentingan rakyat jelata.

    Kebencian Pembangkang terhadap tema itu, kerana mereka selama ini hanya pandai berjanji, akan tetapi mereka senantiasa mungkir janji.

    Janji mereka hanya bersifat retorik, semata-mata untuk merai sokongan politik. Apabila kuasa dimiliki, janji dilupakan.
